Commentary On June 1, 2020, Margot Cleveland wrote in The Federalist that newly declassified Flynn–Kislyak transcripts “confirm” the Mueller team “lied to the court and the country.” She names Van Grack as the prosecutor who stipulated the Statement of Offense facts were “true and accurate,” including that Flynn asked Russia to respond to “U.S. Sanctions” (defined there as Executive Order 13757) only in a reciprocal manner. Cleveland argues the transcripts show Flynn discussed expulsions, not those EO sanctions, and that Van Grack later refused to produce the transcripts to Powell despite Sullivan’s standing order.
The transcripts and the Statement of Offense are documents a reader can compare. Cleveland’s conclusion that Van Grack “lied” is her analysis. It is not a criminal conviction for false statements by Van Grack. This site does not invent a perjury count.
Powell, as Cleveland reports, said the defense had asked for the transcripts for almost a year. If that request is in the docket, it is a request. Withholding a transcript the government said it was “not relying on” for guilt or sentence is what Van Grack told the court, per Cleveland. Quote her as commentary.
