Documented On December 1, 2017, Michael T. Flynn pleaded guilty in the U.S. District Court for the District of Columbia, Criminal No. 17-232. The official transcript lists government counsel as “Brandon Lang Van Grack, Esq.” At the podium he identified himself and Zainab Ahmad for the United States and said Special Agent William Barnett was at counsel table. He told the court the elements of 18 U.S.C. § 1001 and that the government could prove Flynn “made material false statements and omissions during an interview with the Federal Bureau of Investigation on January 24, 2017.” That is what he said on the record. It is not a later finding that the interview was lawfully predicated.
The same day the government filed a Statement of Offense. Later commentary (including Margot Cleveland at The Federalist, June 1, 2020) treats that document as Van Grack’s stipulation. Read the transcripts post as commentary on the document. Do not upgrade it here into a crime by Van Grack.
